1.ACCESS CONTROL POLICY
- (a)The following categories of persons are authorised to access National Guard installations during normal operations:
- (i)All enlisted guardsmen and commissioned officers of the Ridgeway National Guard in good standing;
- (ii)All commissioned officers of the Ridgeway State Guard in good standing;
- (iii)Civilian employees of the Department of Defense.
- (iv)The Governor and the Lieutenant Governor
- (v)State Senate
- (vi)The Judiciary
- (vii)On-duty Law Enforcement Personnel
- (viii)Invited guests to an event under escort by a guardsman
- Commissioned Officers at the rank of Captain and higher are allowed to invite guests to an event that they are managing the event.
- (ix)Members of the Press as recognised by the Department of State, when accompanied by a member of the 3rd Public Affairs Detachment.
- Members of the Press must grant consent for their persons and vehicle to be searched, only if said vehicle is in the perimeter of the National Guard base.
- (x)Other approved personnel as appended by Headquarters.
- (xi)National Guard applicants or interviewees
- During a recruitment session hosted by the 186th Training Battalion only. This applies to Palmer Recruitment Office only.
- (b)All persons entering a National Guard installation shall identify themselves upon request to any guardsman performing security duties.
- (c)The Adjutant General may issue supplementary access control orders for specific installations, which shall take precedence over the general provisions of this Section.
2.WAIVER OF ACCESS CONTROL POLICY
- (a)The Adjutant General may waive any access control requirement under Section 1 for any person or category of person, on a temporary or standing basis.
- (b)The Adjutant General may delegate waiver authority to commissioned officers.
- (c)Authority has been delegated to the following:
- (i)Deputy Adjutant General
- (ii)Assistant Adjutant General
- (iii)State Sergeant Major of the Guard
- (d)Any waiver granted by a delegated officer shall be recorded and reported to the Adjutant General's Office within 6 hours.
3.RESTRICTION, LOCKDOWN, AND TEMPORARY CLOSURE
- (a)The Adjutant General, or a commissioned officer with delegated authority under Section 2, may order a restriction, lockdown, or temporary closure of a National Guard installation where necessary to maintain the security of that installation.
- (b)Grounds for such an order include, but are not limited to:
- (i)A credible or active security threat to the installation or its personnel;
- (ii)An unauthorised intrusion or suspected intrusion;
- (iii)A civil disturbance in the vicinity of the installation; or
- (iv)A event taking place that requires a high security posture.
- (c)A restriction order shall take effect immediately upon issuance and shall remain in force until lifted by the issuing officer or by the Adjutant General.
- (d)Upon issuance of a restriction order, the senior guardsman on duty shall ensure that persons on or approaching the installation are notified of the restriction.
- (e)All restriction orders shall be documented and a report submitted to the Adjutant General's Office as soon as practicable.
- (f)During a restriction, lockdown, or temporary closure, only the following persons are authorised to enter the installation:
- (i)Guardsmen of the Ridgeway National Guard;
- (ii)Civilian employees of the Department of Defense;
- (iii)Civilian law enforcement officers acting in their official capacity; and
- (iv)Employees of the State Guard, where the State Guard has been activated.
- (g)All other persons, including those who would ordinarily be authorised under Section 2, shall be denied entry for the duration of the restriction.
4.INSTALLATION SECURITY DUTIES
- (a)The security of National Guard installations shall be carried out by guardsmen assigned to security duties at the installation.
- (b)Guardsmen on security duty are authorised to:
- (i)Authorise or deny entry to any person seeking access to the installation;
- (ii)Request identification from any person on or seeking entry to the installation;
- (iii)Detain any person found within the installation without authorisation; and
- (iv)Remove or cause to be removed any unauthorised person from the installation.
- (c)Guardsmen shall exercise their authority under this Section with due regard for the safety of all persons involved and in accordance with any post orders issued by the Adjutant General or delegated officers under Section 2.
5.TRESPASS
- (a)During a restriction, lockdown, or temporary closure under Section 4, any person not authorised under Section 4(f) who enters or remains within the installation shall be in violation of this Directive.
- (b)A violation shall constitute Trespassing where:
- (i)The person fails to vacate the installation upon notification by a guardsman or other authorised official; or
- (ii)The person knew, or should reasonably have known, that the installation was subject to a restriction.
- (c)Before initiating detention or removal action, guardsmen shall issue a clear verbal notification to the person, except where circumstances make this impracticable.
- (d)Trespass violations shall be referred to military or civilian law enforcement.
6.DEBARMENT FROM MILITARY INSTALLATIONS
- (a)
Authority- (i)Under § 132.301 of the Code of Statutes, the Adjutant General may promulgate the access control policies of any military installation administered by the National Guard. This Section forms part of that policy.
- (ii)A person subject to a debarment order issued under this Section is not authorised to enter the installation named in the order for the duration of that order.
- (iii)Entry or re-entry in violation of a debarment order constitutes an offence under R.C.C. § 5.09 (Entering National Guard Property), a felony.
- (b)
Issuing Authority- (i)The Adjutant General may issue a debarment order without any restrictions.
- (ii)The following may issue a debarment order not exceeding seven (7) days.
- i. Deputy Adjutant General;
- ii. Assistant Adjutant General;
- iii. Major Subordinate Commanders;
- iv. Headquarters Staff Detachment
- (iii)A debarment order exceeding seven (7) days, or of indefinite duration, may be issued only by the Adjutant General.
- (c)
Grounds- (i)A debarment order may be issued where the person:
- i. Has entered or remained on the installation without authorisation;
- ii. Has committed, or is reasonably suspected of having committed, an offence on or against the installation or its personnel;
- iii. Has vandalised, damaged, or attempted to take National Guard property;
- iv. Has interfered with, obstructed, or harassed guardsmen in the performance of their duties;
- v. Presents a credible threat to the security of the installation or the safety of persons on it; or
- vi. Has repeatedly disregarded lawful directions given by guardsmen performing security duties.
- (ii)A debarment order shall not be issued for the purpose of punishing lawful criticism of the National Guard, the Defense Department, or any officer thereof.
- (i)A debarment order may be issued where the person:
- (d)
Duration- (i)A debarment order shall state a fixed expiry date, or shall be marked indefinite.
- (ii)An indefinite order shall be reviewed by the Adjutant General's Office not less than once every thirty (30) days.
- (iii)An order may be renewed by the issuing authority, or by an authority of higher rank, on the same or fresh grounds.
- (e)
Form of Order- (i)A debarment order shall be in writing and shall state:
- i. The full name and, where known, the identifying particulars of the person debarred;
- ii. The installation or installations to which the order applies;
- iii. The grounds relied upon, in sufficient detail for the person to understand the conduct complained of;
- iv. The commencement date and the expiry date, or that the order is indefinite;
- v. That re-entry in violation of the order is an offence under R.C.C. § 5.09; and
- vi. The manner in which the person may petition for revocation under subsection (h).
- (ii)The order shall be signed by the issuing authority.
- (i)A debarment order shall be in writing and shall state:
- (f)
Service and Notification- (i)A debarment order takes effect upon service on the person.
- (ii)Service shall be effected by actual communication, being either delivery of the written order to the person or the reading of its terms to the person by a guardsman.
- (iii)Where the person cannot be located, the order shall take effect upon the person being informed of its existence and terms by any guardsman at the point of attempted entry, and the written order shall be served as soon as practicable thereafter.
- (iv)The fact, time, and manner of service shall be recorded.
- (g)
Effect and Enforcement- (i)Guardsmen performing security duties under Section 5 shall deny entry to any person subject to a debarment order.
- (ii)Where this order is served on a person who is present on the installation at the time of service, that person shall be directed to leave and given a reasonable opportunity to do so
- (iii)A person who has been served with a debarment order and who thereafter enters, reenters, or is found within the installation, or who fails to leave when directed under (ii), commits an offence under R.C.C. § 5.09 and shall be detained and referred for charge.
- (iv)Violations shall be referred to the Military Police or civilian law enforcement for charge under R.C.C. § 5.09.
- (v)A debarment order does not authorise the use of force beyond that permitted by standing policy on the use of force.
- (h)
Petition for Revocation- (i)A person subject to a debarment order may petition the Adjutant General's Office in writing for its revocation or variation.
- (ii)A petition shall be determined within seven (7) days of receipt, and the determination communicated to the petitioner.
- (iii)A petition may be refused without further consideration where a petition on the same grounds has been determined within the preceding thirty (30) days.
- (iv)The Adjutant General may revoke or vary any debarment order at any time, whether or not on petition.
- (i)
Register and Reporting- (i)The Adjutant General's Office shall maintain a register of all debarment orders in force, recording the person, the installation, the issuing authority, the grounds, and the expiry date.
- (ii)A debarment order issued by a delegated authority shall be reported to the Adjutant General's Office within 6 hours of issuance.
- (iii)The register shall be made available to all guardsmen.
- (iv)An order that has expired or been revoked shall be marked accordingly and shall cease to have effect.
