DETAINMENT & ARREST

1.CIVILIAN DETAINMENT BY NON MILITARY-POLICE GUARDSMAN.

  • - 1. Guardsman are only authorized to detain civilians under any of the following circumstances; - (a) The civilian is trespasser in the MEZ, or on any Military Installation. - (b) The civilian has committed one of the property related offenses against a National Guard property as listed below; - (i) Actively vandalizing or has recently vandalized any National Guard Property. - (ii) Actively or recently committed any act of vehicle theft on a National Guard vehicle. - (c) A civilian has committed or is committing a serious felony, as listed below; - (i) First Degree Murder, Second Degree Murder, Voluntary Manslaughter, Attempted Murder. - (d) A civilian is actively committing or has committed any listed below offenses, on a guardsman; - (i) Any form of Battery. - (ii) Any form of Assault. - (e) Guardsman are authorized to detain civilians, that are actively being pursued by Law Enforcement.
    • (a) The civilian is trespasser in the MEZ, or on any Military Installation.
    • (b) The civilian has committed one of the property related offenses against a National Guard property as listed below;
      • (i) Actively vandalizing or has recently vandalized any National Guard Property.
      • (ii) Actively or recently committed any act of vehicle theft on a National Guard vehicle.
    • (c)A civilian has committed or is committing a serious felony, as listed below;
      • (i) First Degree Murder, Second Degree Murder, Voluntary Manslaughter, Attempted Murder.
    • (d)A civilian is actively committing or has committed any listed below offenses, on a guardsman;
      • (i) Any form of Battery.
      • (ii) Any form of Assault.
    • (e) Guardsman are authorized to detain civilians, that are actively being pursued by Law Enforcement.
  • - 2. For all the offenses listed above, guardsman MUST have evidence of the event, since guardsman are not considered Law Enforcement, if a Law Enforcement Officer did not witness the event, guardsman are required to give the evidence to a LEO, as said LEO may not have Probable Cause without evidence.

2.MILITARY POLICE AUTHORITY ON CIVILIANS.

  1. Military Police have full Law Enforcement authority and are allowed to use law enforcement powers, and may enforce felonies and misdemeanors, state-wide. Military Police should however adhere to National Guard policy and regulations.
