1.TYPE II OFFENSES

  • (a)Misuse of Official Position
    • (i)Misuse of official position is the act of acquiring employment only to benefit a person’s private gain by using official powers, duties, and responsibilities.
    • (ii)This violation may be committed while On-Duty
    • (iii)This violation may be committed while Off-Duty
  • (b)Failure to Disclose Conflict of Interest
    • (i)Failing to disclose a potential conflict of interest that may affect your ability to perform your duties without bias.
    • (ii)This violation may be committed while On-Duty
    • (iii)This violation may be committed while Off-Duty
  • (c)Failure to Properly Uphold Duties
    • (i)Failing to uphold a duty as prescribed by state laws or by regulations, failing to properly execute the code of conduct, failing to act on a complaint while in a position of authority, or failing to act as a Military Police Officer when witnessing a guardsman break the code of conduct, state laws, or traffic laws.
    • (ii)This violation may be committed while On-Duty
    • (iii)This violation may be committed while Off-Duty
  • (d)Gross Incompetency
    • (i)Any person who commits an action or fails to commit thereof; because they lack common sense or that a certain regulation exists.
    • (ii)This violation may be committed while On-Duty
  • (e)Harassment
    • (i)The act of applying aggressive pressure to another guardsman or citizen of the public or attempts to intimidate another guardsman or citizen.
    • (ii)This violation may be committed while On-Duty
  • (f)Conduct Prejudicial to the Government
    • (i)Committing a misdemeanor or felony against the County and State of Ridgeway.
    • (ii)This violation may be committed while On-Duty
    • (iii)This violation may be committed while Off-Duty
      • - 1. Shall be evaluated on a case-by-case basis.
  • (g)Strike Violation
    • (i)Any person who accumulates (3) strikes while employed in the Ridgeway National Guard.
    • (ii)This violation may be committed while On-Duty
    • (iii)This violation may be committed while Off-Duty
  • (h)Officer Strike Violation
    • (i)Any commissioned officer who accumulates a strike while employed in the Ridgeway National Guard.
    • (ii)This violation may be committed while On-Duty
    • (iii)This violation may be committed while Off-Duty
  • (i)Absence without Leave
    • (i)Any person who fails to report after a period of (2) weeks, or any person who is not on a peacetime route or at a military installation without proper authorization, or any person who fails to report to the National Guard team when required to.
    • (ii)This violation may be committed while On-Duty
    • (iii)This violation may be committed while Off-Duty
  • (j)Assault on Superior Commissioned Officer
    • (i)The act of intentionally causing great bodily harm against a superior commissioned officer.
    • (ii)This violation may be committed while On-Duty
    • (iii)This violation may be committed while Off-Duty
  • (k)Manslaughter
    • (i)Killing a person recklessly, without malicious intent.
    • (ii)This violation may be committed while On-Duty
  • (l)Disrespect towards a Superior Commissioned Officer
    • (i)Intentional disrespect against a Superior Commissioned Officer of the Ridgeway National Guard.
    • (ii)This violation may be committed while On-Duty
  • (m)Reckless Action
    • (i)Any person, while doing any action that may leave bodily harm to a person or deprive them of significant interest or liberties, in a reckless or careless manner.
    • (ii)This violation may be committed while On-Duty
  • (n)Conspiracy
    • (i)Any person who purposefully conspires with another person to violate National Guard Regulations.
    • (ii)This violation may be committed while On-Duty
    • (iii)This violation may be committed while Off-Duty
  • (o)Rioting or Breach of the Peace
    • (i)Any person who intentionally riots or breaches the peace.
    • (ii)This violation may be committed while On-Duty
    • (iii)This violation may be committed while Off-Duty
  • (p)Hatch Act Violation
    • (i)Acts that
      • i. Use official authority to influence the results of an election.
      • ii. Participation in political actions while On-Duty and actively representing the guard.
      • iii. Wearing political clothing or accessories while on duty or actively representing the guard.
      • iv. Allowing official title to be used in a state of support or disagreement of a political question or candidacy.
      • v. Solicit or discourage the political activity of any member of the National Guard.
      • vi. Solicit political contributions to a speech before a political activity or event.
  • (q)Insubordination
    • (i)Willfully disobeys a Superior Commissioned or Non-Commissioned Officer.
    • (ii)This violation may be committed while On-Duty
  • (r)Failing to Complete Basic Military Training
    • (i)The act of failing to attend phases or completing the final exam within the given time; The act of scoring below average on the final exam.
    • (ii)This violation may be committed while On-Duty
    • (iii)This violation may be committed while Off-Duty
  • (s)Duty to Report
    • (i)Employees of the Ridgeway National Guard are required to report any and all misconduct they within from another employee. Withholding evidence of any employee violating department policy or law is prohibited.
    • (ii)This violation may be committed while On-Duty
    • (iii)This violation may be committed while Off-Duty
    • (iv)Violators may be issued disciplinary action if they fail to report misconduct.
  • (t)Abuse of Authority
    • (i)Any guardsman of a higher rank that falsely issues out punishment, discipline, or orders without a justified reason are guilty of abusing their authority.
    • (ii)This violation may be committed while On-Duty
    • (iii)This violation may be committed while Off-Duty
  • (u)Zero Tolerance
    • (i)Upon receiving any punitive-related verbal warnings or administrative strikes on an employee record while the employee is on a period of probation, the Military Police Investigations platoon is directed to terminate the employee.
    • (ii)This violation may be committed while On-Duty
    • (iii)This violation may be committed while Off-Duty
  • (v)Internal Malfeasance
    • (i)Lying, fraudulence, or any other form of immoral character behavior in a manner that disrupts or obstructs the internal administrative processes of the Military Police Investigations Platoon
    • (ii)This violation may be committed while On-Duty
    • (iii)This violation may be committed while Off-Duty
  • (w)Violating a Military Department Policy
    • (i)Any Guardsmen who knowingly or unknowingly breaches, breaks, or violates any Operational Regulation as set out by: , or policy set out by their respective Regiment, Battalion, Detachment, and Division, or who violates any executive order/and or directive.
    • (ii)This violation may be committed while On-Duty
    • (iii)This violation may be committed while Off-Duty
  • (x)Failure to abide by search agreement
    • (i)Any Guardsmen that fails to sign the Mandated “DA 10” Search Agreement within a period of 24 hours upon their acceptance into the guard.
    • (ii)Or any Guardsmen who upon request of a Headquaters or Military Police Investigations Official declines, refuses, or deliberately avoids being searched.
    • (iii)This violation may be committed while On-Duty (vi) This violation may be committed while Off-Duty
  • (y Failure to Report
    • (i)Any Guardsmen that fails to sign the Mandated “DA 10” Search Agreement within a period of 24 hours upon their acceptance into the guard.
    • (ii)Or any Guardsmen who upon request of a Headquaters or Military Police Investigations Official declines, refuses, or deliberately avoids being searched.
    • (iii)This violation may be committed while On-Duty (vi) This violation may be committed while Off-Duty
