1.TYPE III OFFENSES

  • (a)Disruption of Official Event
    • (i)Any person who attempts to disrupt an official National Guard event.
    • (ii)This violation may be committed while On-Duty
    • (iii)This violation may be committed while Off-Duty
  • (b)Reckless Conduct
    • (i)Acting in a careless or irresponsible manner that creates unnecessary risk to personnel, property, or operations.
    • (ii)This violation may be committed while On-Duty
  • (c)Repeat Failure to Maintain Professional Attire
    • (i)Any person not wearing official National Guard uniforms after being repeatedly asked to do so.
    • (ii)This violation may be committed while On-Duty
  • (d)Repeat Failure to Maintain Professional Stature
    • (i)Any person not maintaining professional stature after being repeatedly told to do so.
    • (ii)This violation may be committed while On-Duty
  • (e)Failure to Uphold Duties
    • (i)Failing to uphold duty as prescribed by regulation, failing to properly execute the code of conduct, failing to act on a complaint while in a position of authority, failure to complete an activity cycle, failing to complete tasks and duties assigned to one within the granted timeframe.
    • (ii)This violation may be committed while On-Duty
    • (iii)This violation may be committed while Off-Duty
  • (f)Gross Incompetency
    • (i)Any person who commits an action or fails to commit thereof; because they lack common sense or that a certain regulation exists.
    • (ii)This violation may be committed while On-Duty
    • (iii)This violation may be committed while Off-Duty
  • (g)Verbal Request for Promotion
    • (i)Any person who makes an unsolicited request to a superior for a promotion via voice or text.
    • (ii)This violation may be committed while On-Duty
    • (iii)This violation may be committed while Off-Duty
  • (h)Improper Hazarding of a Vessel or Motor Vehicle
    • (i)Any person who, while using National Guard vehicles, improperly puts themselves, property of the National guard, or another person in danger.
    • (ii)This violation may be committed while On-Duty
  • (i)Repeat Failure to Maintain Professional Outlook
    • (i)Any person who acts in such a manner that would cause the National Guard to be viewed poorly through the persons incompetence or general idiocy.
    • (ii)This violation may be committed while On-Duty
    • (iii)This violation may be committed while Off-Duty
  • (j)Repeat Failure to Use Proper Terminology
    • (i)Failing to address officers or enlisted in the proper manner, after being asked repeatedly to do so.
    • (ii)This violation may be committed while On-Duty
  • (k)Contempt towards Officials
    • (i)This violation may be committed while On-Duty
    • (ii)This violation may be committed while Off-Duty
    • (iii)Public showing of contempt or hatred towards any Officer of the Ridgeway National Guard.
      • i. This is not intended to limit the free speech, as they may do such in a private, non-public manner.
  • (l)Disrespect towards Superior Commissioned Officers
    • (i)Intentional disrespect against a Superior Commissioned Officer of the Ridgeway National Guard.
    • (ii)This violation may be committed while On-Duty
  • (m)Unlawful Detention
    • (i)Arrest, or suspension: Detaining, Suspended or Arresting someone without proper legal authority, or legal means to do such.
    • (ii)This violation may be committed while On-Duty
  • (n)Insubordination
    • (i)The act of failing to follow the orders of a Superior Officer, written or unwritten.
    • (ii)This violation may be committed while On-Duty
  • (o)Internal Malfeasance
    • (i)Lying, fraudulence, or any other form of immoral character behavior in a manner that disrupts or obstructs the internal administrative processes of the Military Police Investigations Platoon
    • (ii)This violation may be committed while On-Duty
    • (iii)This violation may be committed while Off-Duty
  • (p)Unauthorized use of a restricted vehicle
    • (i)Any guardsman who uses a vehicle without the proper authorization or who violates policies specific to certain vehicles as prescribed by OPREG 1007 "VEHICLE POLICY
    • (ii)This violation may be committed while On-Duty
  • (q)Failure to Maintain Professional Outlook
    • (i)Any person who acts in such a manner that would cause the National Guard to be viewed poorly through the person's incompetence or general idiocy.
    • (ii)This violation may be committed while On-Duty
    • (iii)This violation may be committed while Off-Duty
  • (r)Violating a Military Department Policy
    • (i)Any Guardsmen who knowingly or unknowingly breaches, breaks, or violates any Operational Regulation as set out by: , or policy set out by their respective Regiment, Battalion, Detachment, and Division
    • (ii)This violation may be committed while On-Duty
    • (iii)This violation may be committed while Off-Duty
